Acceptance of Terms

By accessing and using the services provided by SolarByte GmbH ("SolarByte", "we", "our", or "us"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

These terms of service apply to all users of our website, customers of our renovation services, and any other interactions with SolarByte. By engaging our services or using our website, you confirm that you have read, understood, and agree to these terms.

Company Information

Services Description

SolarByte provides professional renovation and construction services including but not limited to kitchen renovations, bathroom renovations, complete home renovations, flooring installation, painting and decorating, electrical work, plumbing services, tiling, and carpentry services.

All services are provided in accordance with German building regulations and industry standards. We reserve the right to modify or discontinue any service at any time without notice.

User Obligations

By using our services, you agree to the following obligations and responsibilities:

General Obligations

• Provide accurate and complete information when requesting quotes or services
• Ensure safe and reasonable access to your property for our team
• Obtain necessary permissions and permits where required
• Make timely payments according to agreed terms
• Communicate any changes or concerns promptly

Property Access and Safety

• Ensure clear and safe access to work areas
• Remove or protect valuable items from work areas
• Inform us of any hazards or special conditions on the property
• Provide necessary utilities (water, electricity) during work periods

Prohibited Uses

You may not use our services for any unlawful purpose or in any way that could damage, disable, overburden, or impair our business operations. You agree not to interfere with our work or the safety of our personnel.

Quotations and Pricing

All quotations are provided free of charge and are valid for 30 days from the date of issue unless otherwise specified. Prices are subject to change based on material costs, project modifications, or unforeseen circumstances discovered during work.

Final pricing may vary from initial estimates if additional work is required or if project specifications change. We will obtain your approval before proceeding with any work that exceeds the agreed quote by more than 10%.

All prices are quoted in Euros and include applicable VAT unless otherwise stated. Payment terms will be specified in individual contracts and typically include staged payments linked to project milestones.

Payment Terms

Payment terms are specified in individual service contracts. Generally, we require a deposit to secure booking, with progress payments during the project and final payment upon completion.

• Deposits are typically 20-30% of the total project cost
• Progress payments are linked to completion milestones
• Final payment is due upon project completion and sign-off
• Late payment charges may apply to overdue accounts
• We reserve the right to suspend work for non-payment

We accept bank transfers, major credit cards, and other payment methods as agreed. All payments must be made in Euros unless otherwise arranged.

Project Timeline and Delays

Project timelines are estimates based on normal working conditions and are subject to factors beyond our control including weather, material availability, permit delays, and unforeseen site conditions.

We will make reasonable efforts to complete projects within estimated timeframes but cannot guarantee specific completion dates. SolarByte shall not be liable for delays caused by circumstances beyond our reasonable control.

Warranties and Guarantees

We provide warranties on our workmanship as follows:

• General renovation work: 2 years from completion
• Electrical and plumbing work: 1 year from completion
• Painting and decorating: 1 year from completion
• Structural work: 5 years from completion

Warranties cover defects in workmanship but exclude normal wear and tear, damage caused by misuse, or failure to maintain the work properly. Material warranties are provided by manufacturers and are separate from our workmanship guarantees.

Intellectual Property

All content on the SolarByte website, including text, graphics, logos, images, and software, is the property of SolarByte or its content suppliers and is protected by German and international copyright laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our website without our prior written consent.

Design plans, specifications, and other materials created specifically for your project remain the property of SolarByte unless otherwise agreed in writing. You are granted a licence to use these materials for the specific project only.

Limitation of Liability

SolarByte's liability for any claim arising from our services shall not exceed the total amount paid for the specific service giving rise to the claim. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

We maintain comprehensive public liability insurance and professional indemnity insurance. Our liability is limited to the extent permitted by German law and the terms of our insurance policies.

This limitation of liability applies to all claims whether based in contract, tort, strict liability, or any other legal theory, even if SolarByte has been advised of the possibility of such damages.

Force Majeure

SolarByte shall not be liable for any failure or delay in performance under these terms which is due to fire, flood, earthquake, elements of nature, acts of God, acts of war, terrorism, riots, civil disorders, rebellions, or other similar causes beyond our reasonable control.

Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which forms part of these terms. By using our services, you consent to the collection and use of your information as outlined in our Privacy Policy.

Governing Law

These terms of service and any disputes arising from or related to our services shall be governed by and construed in accordance with the laws of Germany, specifically the laws applicable in Baden-Württemberg.

Any legal proceedings arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of Stuttgart, Germany. Both parties consent to the jurisdiction of such courts and waive any objections to venue.

Dispute Resolution

We are committed to resolving any disputes amicably and efficiently. If you have a complaint about our services, please contact us first to discuss the matter.

If a dispute cannot be resolved through direct discussion, both parties agree to attempt mediation before pursuing legal action. Mediation shall be conducted in accordance with German mediation procedures.

Termination

Either party may terminate a service contract with written notice, subject to the specific terms outlined in individual contracts. Termination does not relieve either party of obligations incurred prior to termination.

Termination by Customer

Customers may terminate projects with reasonable notice, but may be liable for work completed, materials ordered, and reasonable cancellation costs. Deposits paid may be forfeited depending on work already undertaken.

Termination by SolarByte

We may terminate projects immediately if payment terms are not met, if access to the property is denied, or if the customer breaches these terms. In such cases, payment for work completed remains due.

Changes to Terms

SolarByte reserves the right to modify these terms of service at any time. Changes will be effective immediately upon posting on our website. Continued use of our services after changes are posted constitutes acceptance of the modified terms.

For ongoing projects, significant changes to terms will be communicated directly to affected customers and will not apply retroactively to existing contracts unless mutually agreed.

Severability

If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these terms shall otherwise remain in full force and effect and enforceable.

Entire Agreement

These terms of service, together with our Privacy Policy and any individual service contracts, constitute the entire agreement between you and SolarByte regarding our services and supersede all prior or contemporaneous communications and proposals.
